Agreement to Terms

By accessing or using the Phase Zero Space Technologies ("PZST") website and ELSSA platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

Description of Services

PZST provides the ELSSA (Easy Launch Site Safety Compliance Automation) platform, which automates range safety compliance processes, including AFSPCMAN 91-710 requirements tailoring, range safety deliverable generation, and FAA launch license automation.

User Accounts

To access certain features of our services, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current

Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Reverse engineer, decompile, or attempt to extract source code
• Use our services to transmit malware, viruses, or harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Share account credentials or allow unauthorized access to your account

Intellectual Property

All content, features, and functionality of our services—including but not limited to software, text, graphics, logos, and trademarks—are owned by PZST and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Data and Content

Your Data

You retain ownership of data you submit to our platform. By using our services, you grant PZST a limited license to process your data as necessary to provide our services.

Compliance Responsibility

While ELSSA assists with compliance processes, you remain solely responsible for ensuring your operations comply with all applicable laws, regulations, and requirements. ELSSA is a tool to assist with compliance—not a substitute for professional judgment or official regulatory review.

Confidentiality

We understand the sensitive nature of range safety and compliance data. We maintain strict confidentiality of your information in accordance with our Privacy Policy and applicable security standards.

Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may temporarily suspend services for maintenance, updates, or circumstances beyond our control.

Fees and Payment

Access to ELSSA platform features may require payment of fees as specified in your service agreement. Fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with reasonable notice.

Limitation of Liability

To the maximum extent permitted by law, PZST shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be error-free, uninterrupted, or meet your specific requirements.

Indemnification

You agree to indemnify and hold harmless PZST, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

Termination

We may suspend or terminate your access to our services at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to use our services ceases immediately.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Maricopa County, Arizona.

Changes to Terms

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of our services after changes constitutes acceptance of the modified terms.
